IMPORTANT: LIABILITY RELEASE & TERMS OF USE

TERMS, POLICIES, and LIABILITY WAIVER BELOW outlined below*

 

By making a payment and/or registration for SoHo Shakespeare Company, Inc.'s Classes, Workshops, Events, and/or Studio Rentals (the "Studio"), You—and in the case of Rentals, all parties using Studio with You—("You") acknowledge and agree to the Studio Rules and the following legally binding terms:

1. Assumption of Risk: You acknowledge that rehearsals, movement, and the use of props and set involve inherent physical risks. You voluntarily assume all risks of personal injury, property damage, and/or loss sustained while on the premises, whether caused by your actions, your guests, or the condition of the studio.

2. Release and Waiver of Liability: To the fullest extent permitted by law, your enrollment, registration and/or payment serves as a full release of SoHo Shakespeare Company, Inc., its owners, and employees, from any and all liability. This includes any claims for injury (including death) or property damage occurring during the period You are in the Studio, regardless of whether such loss is caused by the negligence of the Studio or otherwise.

3. Indemnification: You agree to defend and hold SoHo Shakespeare Company, Inc., its owners, and employees, harmless from any claims or legal costs (including attorney fees) brought by You and/or any third parties—such as your guests, patrons, cast, crew, or students—arising out of your use of the space.

4. Acceptance of "As-Is" Condition: Payment constitutes that You accept and agree to the Studio in its current "AS-IS" condition. You agree that the space is suitable for your intended use and that no warranties of safety or fitness have been made.

5. Consent by Payment: You agree that the act of registering and/or paying the rental fee/tuition costs constitutes a digital signature and your full, unconditional agreement to this Release of Liability.

STUDIO RULES

 

The SoHo Shakespeare Company Studio is our creative home

Our small group of staff work diligently to keep it cleanand in proper working order.

Please treat our home with respect, generosity, and kindness.

  • Clearing the space is part of your rental time. All activities must end at least 5 minutes prior to end of rental to allow yourself time to clear the space for the next group.

    • Return folding chairs, folding tables, and/or any furniture to its original location.

  • A $10 fee will be applied to Renter for missing bathroom keys

  • Live plants are not rehearsal props

  • Lift furniture, do not drag. This will scratch the floors

  • Do not stand on chairs or furniture

  • Do not sit or stand on folding tables

  • Cleaning supplies in closet next to lockers

  • Door must remain closed for climate and noise control

  • Do not touch or use ladder

  • No chairs are to be placed in the hallway. Hallways are not gathering or waiting areas.

  • You will not authorize others to use the Studio or building under your account, and you may not assign or otherwise transfer your rental to any other person or entity.

  • No weapons of any kind are allowed on property.

    • You must notify your instructor/administrator before bringing in prop weapons

  • Damaged property will be assessed. Replacement/repair costs may be applied to Renter.

  • Clear all garbage when leaving. Use the garbage and recycling bins near the door.

  • Items left behind will be stored in Lost & Found for 30 days

  • Smoking is not permitted anywhere in the building.

  • Alcohol may not be sold on premises.

  • No flame of any kind, including incense, is permitted in the building.

  • Photography and Videography are not permitted anywhere outside of the Studio without prior written consent from Company and Building Management.

  • NYC regulations on sexual harassment & discrimination posted must be followed.

  • Turn off A/C when leaving

  • Turn off lights when leaving

CANCELLATION/WITHDRAWAL POLICY

We understand that the industry is unpredictable and our schedules as artists can change quickly. For that reason, if your obligations change and you can no longer participate in a given session after having enrolled, you may request to transfer your tuition payment to a future session, so long as you do so seven or more days before the start of the first class. In order to withdraw, you must email an official request to training@sohoshakes.org as soon as possible. The date and time your email is sent will be considered the official withdrawal date and time in determining transfer eligibility.

MAKEUP CLASS POLICY

Make-up sessions in case of illness or severe inclement weather (snowstorms, etc) may be offered to students who give the teacher 24-hours notice and will be subject to availability. Make-ups will be virtual by default and must be fulfilled within the given round of class. Make-up sessions will not be given for lessons canceled with less than 24-hours notice. In the case the teacher has to cancel, a make-up lesson or a substitute teacher will be provided.

COVID-19 POLICY

for In-Person Training

All registrants of any SoHo Shakespeare Company in-person class, training, workshop, coaching, etc. [hereby "classes"], must be vaccinated against COVID-19 and able to provide proof of their vaccination status.  All registrants must also agree to follow the instructor's guidance as to the use of masks in classrooms and common spaces associated with SoHo Shakespeare Company in-person classes.  Should a registrant not be vaccinated, fail to provide proof of vaccination, or fail to follow the instructor's guidance on mask wearing, the registrant will be removed from the class without eligibility for a refund, and will not be considered for future SSC activities.  Online classes do not require vaccination.

 

TERMS & CONDITIONS

The following Terms & Conditions apply solely to the intended class participant:

SOHO SHAKESPEARE COMPANY (SSC) WORKSHOPS AND CLASSES ARE FOR ARTISTIC DEVELOPMENT AND EDUCATIONAL PURPOSES ONLY AND WILL NOT SECURE OR PROVIDE OPPORTUNITY FOR EMPLOYMENT IN THE FIELD.  BY REGISTERING FOR ANY SSC CLASS OR WORKSHOP YOU CONFIRM THAT YOU ARE AT LEAST 18 YEARS OF AGE. BY REGISTERING FOR ANY SSC CLASS AND/OR WORKSHOP YOU AGREE TO JOIN OUR GENERAL MAILING LIST FROM WHICH YOU MAY UNSUBSCRIBE AT ANY TIME. NOTICE ON ZOOM RECORDINGS: ANY RECORDINGS OF SESSIONS AND PARTS THEREOF MADE BY THE HOST [INSTRUCTOR] ARE FOR INTERNAL USE ONLY AND WILL NEVER BE SHARED, PUBLISHED, OR IN ANY WAY USED FOR MARKETING PURPOSES WITHOUT THE EXPRESSED AFFIRMATIVE CONSENT OF EACH PERSON APPEARING IN THE RECORDING. FOR PURPOSES OF PRIVACY, STUDENT RECORDINGS OF WORK SESSIONS ARE PROHIBITED.
